Memorandum of Understanding
On Cooperation Between the Police of the Republic of Armenia And The Ministry of Interior of the Islamic Republic of Iran
The Ministry of Interior of the Islamic Republic of Iran and the Police of the Republic of Armenia hereinafter referred to as "The Parties"
Considering the existing friendly relations between the two States,
Recognizing the importance of the development and strengthening of bilateral cooperation in the field of mutual interest,
Respecting national sovereignty rights, territorial integrity, national laws and regulations and international obligations of both Parties,
have agreed as follows:
Article 1
Fields of cooperation
In compliance with this Memorandum of Understanding the Parties agree to realise cooperation on detection of criminals and prevention, suppression, disclosure of crimes in the following areas:
1. transnational organized crime and terrorism,
2. preventing and combating supply, production, storage, distribution, transportation, trading and abuse of narcotic drugs, psychotropic substances and eradication of resources of production and processing of drugs and basic chemical substances used in manufacturing of narcotic drugs,
3. illicit trafficking of movables, cultural and historical values,
4. counterfeiting of government bonds and securities, travel documents, currencies, credit cards and other valuable documents,
5. money laundering and the use of revenues generated thereof,
6. trafficking in human beings especially in women and children and illegal migration,
7. cyber crime and other crimes that are committed by using telecommunication technologies.
Article 2
Manners of cooperation
Each Party, at the request of the other Party or on his own initiative, will take the following measures to execute the provisions of Article 1 of the present Memorandum:
1. exchange of information and identification of persons and groups involved in transnational organized crime,
2. exchange of information on various kinds of transnational organized crime, as well as on methods, equipments, modus operandi used by terrorist groups and other groups of transnational organized crime aimed against the interests of each or both Parties, based on best practice of combating them,
3. exchange of information on laws about preventing and combating crimes mentioned in this MoU,
4. organizing of mutual visits of experts specialized in combating organized crime, terrorism, and other types of crimes set in the present Memorandum for the development of mutual cooperation,
5. organizing of specialized training courses, seminars and discussions for relevant authorities of each Party,
6. exchange of information on new types of narcotic drugs, psychotropic substances, basic chemical prosecutors as well as routs used for drug trafficking,
7. exchange of experience on using of new methods of detection and inspection of narcotic drugs and psychotropic substances, as well as methods of using technical and other means for fighting narcotic drugs,
8. exchange of information about the citizens of each Party's, who are arrested for committing crimes in the territory of the other Party,
9. carrying out of joint scientific researches on crime detection,
10. exchange of information and experience on police related equipments,
11. by the request of one of the Parties taking measures for the detection of persons wanted by the competent authorities of the other Party,
12. activation of cooperation in the fight against organized crime within the framework of the activities of International Criminal Police Organization-INTERPOL.
Article 3
Joint working group and subcommittees of experts
The Parties agreed to establish a working group headed by Security Adviser and Director General of the Ministry of Interior of the Islamic Republic of Iran and the head of the Headquarters of the Police of the Republic Armenia. The working group shall be comprised of equal numbers of representatives of the both Parties in order to follow and supervise the perfect implementation of the present Memorandum and to consider the proposals on the new areas of cooperation.
The sessions of the working group shall be held annually and alternatively in the territory of both countries.
In some cases, when necessary, an extra ordinary session may be convened by mutual consent.
The Parties may establish subcommittees of experts to provide the implementation of this Memorandum.
Article 4
Confidentiality of the information and documents
Information, documents and what so ever exchanged in the framework of the Memorandum will be considered as confidential and be used only in line with related purposes of the submitting Party.
Such documents and information can be provided to a third Party only after prior written agreement of the submitting Party.
Article 5
Language of communication
The requests within the framework of this Memorandum and other documents linked shall be prepared in English language and in case of being prepared in native languages of the Parties must be forwarded in addition with covered English translation and confirmed by the set form.
Article 6
Settlement of disputes
Any dispute between the Parties arising from the interpretation or implementation of the present Memorandum will be settled through direct negotiations of the joint working group set in Article 3, otherwise, it will be settled through diplomatic channels without reference to any third state.
Article 7
Responsible Authorities
The responsible authorities of the Parties for implementation of this Memorandum are:
a) On behalf of the Police of the Republic of Armenia adjunct to the Government of the Republic of Armenia
The Headquarters of the Police of the Republic Armenia.
b) On behalf of the Ministry of Interior of the Islamic Republic of Iran
The General department of Security Affairs of the Ministry of Interior of the Islamic Republic of Iran.
Article 8
Entry into force
The present Memorandum of Understanding shall enter into force on the date of the last notification through diplomatic channels on fulfillment of relevant internal procedures provided for in the national legislation of the Parties and has been concluded for an indefinite period of time.
The Agreement can be terminated by either Party by a written notification through diplomatic channels and expires six months after the receipt of the notification.
With the initiative and mutual consent of the Parties, amendments and additions can be made to the present Memorandum, which will be made as a separate protocol.
The protocol will enter into force in accordance with the procedures established in the present Memorandum and will become the integral part of it.
This MoU is signed in 8 articles, in Yerevan, on 10 July, 2012, H.S. corresponding to 1391 Tir 20 A.D. in two original copies, each in Armenian, Persian and English languages, all texts being equally authentic.
In case of divergence in the interpretation, the English text shall prevail.
The Memorandum of Understanding has entered into force on 30.10.2012.
